Le dommage corporel est une atteinte à l’intégrité physique et/ou psychique d’une personne, celle-ci peut être durable ou non. Un dommage peut entraîner des conséquences, sur la santé, la vie quotidienne et professionnelle. Afin d’évaluer les incapacités de la personne, une expertise est faite par une équipe pluridisciplinaire (assureurs de la victime et du fautif, avocats des partis, médecin…) L’ergothérapeute en fait partie. Il va à travers ses compétences, ses valeurs et son éthique évaluer la personne dans son quotidien et envisager des compensations matérielles et humaines pour répondre à ces besoins.
L’objectif de la recherche est de montrer que l’ergothérapeute agit avec ses compétences, ses valeurs et son éthique quel que soit l’expertise.
L’étude qualitative a été réalisée entre octobre 2021 et juin 2022. La recherche est basée sur quatre entretiens, à la suite d’une recherche littéraire. Quatre ergothérapeutes de différents domaines (assurance, juridique, recours) ont été interviewés.
Les ergothérapeutes experts sont capables d’agir avec respect, loyauté, impartialité et objectivité. Ils apportent leurs compétences telles qu’effectuer un entretien, passer des bilans, proposer des mises en situation, préconiser des aides techniques et humaines et aménager l’environnement. Pour eux, répondre aux besoins de la victime et de ses attentes est une des spécificités de l’ergothérapie. Néanmoins, leurs valeurs et leur éthique peuvent être compromises par des pressions des parties en ce qui concerne l’indemnisation de la victime. Pour pallier cela certains discutent du principe de l’évaluation contradictoire afin de limiter ces dérives.
L’étude montre que les ergothérapeutes peuvent avoir leurs valeurs et éthique de bafouées. Leur rapport permet d’appuyer leur préconisations pour la victime. C’est un élément essentiel de l’expertise, grâce à cela les ergothérapeutes fiabilise leur propos et tente de poser un cadre dans cette pratique. Néanmoins la création d’un code de déontologie de la profession en France serait indispensable.

Introduction: Personal injury is an attack to the physical and/or psychological integrity of a person, which may or may not be permanent. An injury can have consequences on their health, daily and professional life. In order to assess the person's incapacity, an expertise is carried out by a multidisciplinary team consisting in insurers, lawyers, doctors, occupational therapist. Through their skills, values and ethics they will assess the person's daily life and consider material and human compensation to meet these needs.
Objectives: The aim of the research is to show that the occupational therapist acts with their skills, values and ethics, in any type of expertise.
Methods: A qualitative study was conducted between October 2021 and June 2022. The research is based on four interviews, following a literature search. Four occupational therapists from different fields (insurance, legal, redress) were interviewed.
Results: Expert occupational therapists are able to act with respect, loyalty, impartiality and objectivity. They provide skills such as conducting an interview, carrying out assessments, offering scenarios, recommending technical and human aids and adapting the environment. Meeting the needs of the victim and their expectations is one of the specificities of occupational therapy. However, their values and ethics may be compromised by pressure from the parties regarding the victim's compensation. In order to counteract this, the principle of contradictory assessment is discussed in order to limit such abuses.
Discussion/Conclusion: The study shows that occupational therapists can have their own values and ethics violated. Their report makes it possible to support their recommendations for the victim. This is an essential element of the expertise, thanks to which occupational therapists can be more reliable and try to establish a framework for their practice. Nevertheless, the creation of a code of ethics for the profession in France would be essential. - IFE NEVERS
